GENERAL TERMS

INTRODUCTION

These terms and conditions apply to all clients (referred to as "you", "your", "client", or "patient") who use or purchase Products and/or Services from Radiant Naturopathics (ABN: 48 915 497 972), its contractors, employees, related entities, successors, and assigns (referred to as "we", "us", or "our").

DEFINITIONS

The following capitalised words in these Terms have specific meanings:

Business: Refers to our online and in-person naturopathic clinic (Clinic), which includes our dispensary.

Products: Refers to natural supplements, herbal tonics, topical applications (creams, ointments, liniments, pessaries, suppositories, soaks etc.), and educational materials.
Examples: Health and beauty-related items, including herbal tonics, supplements, personal care products, baby/pregnancy goods, and educational resources made available for purchase.

Services: Refers to naturopathic consultations and personalised treatment plans.
Examples: In-clinic or online consultations with our healthcare practitioners (naturopaths, nutritionists, herbalists) and the provision of personalised treatment plans, including recommendations, advice, and other services offered periodically.

By using our Products and Services, you agree to be bound by these Terms as well as our Privacy Policy (collectively referred to as "Documents"), which are available on our website or upon request. These Documents outline the legal relationship between you and us.

By purchasing or using our Products and Services, you confirm that you have had the opportunity to read these Terms, have accepted them, and agree to comply. You must be 18 years or older, or, if under 18, a parent or guardian must review and agree to these Terms on your behalf. If you or your parent/guardian do not agree to the Terms, you must cease using our Products and Services.

 

FEES AND PAYMENTS

Fees:

We will provide our fee details either at the time of booking, purchase, or upon request. By continuing to use our Services or purchasing Products, you agree to pay the applicable fees, including postage, delivery charges, cancellation, or no-show fees as outlined in these Terms. An invoice for Products or Services will be provided.

Prices:

All prices are listed in Australian dollars unless stated otherwise and are subject to change with notice. Prices are fixed once your order is confirmed, unless otherwise specified.

GST:

Australian Goods and Services Tax (GST) applies to applicable Products and Services and will be itemised on your invoice. By agreeing to these Terms, you consent to pay the GST on applicable charges.

Payments:

Unless otherwise agreed by us in writing, all payments are due at the time you book or receive a Service, or when an order is placed for Products. Payments can be made via credit/debit card or bank transfer.

Cancellation Policy:

We kindly request that you notify us at least 24 hours in advance if you need to reschedule. This courtesy allows us to keep our schedule running smoothly and ensure everyone has the opportunity to receive the care they need. Cancellations made within 24 hours may incur a fee of 50% of the appointment cost. Notification of changes can be made via email at aimee@radiantnaturopathics.com.au or through the Patient Portal for returning clients.

Refund Policy:

If you wish to request a refund, please submit your request via email, clearly stating the amount and reason for the refund. We will review your request and respond within 14 business days. Refunds are granted at our discretion, except as required by Australian Consumer Law. Please note that we may refuse refunds for change of mind.

 

DISCLAIMER AND LIMITATION OF LIABILITY

Products and Services:

It is your responsibility to ensure any Product or Service meets your individual needs. Before purchasing Products or engaging our Services, we recommend that you assess their suitability for your circumstances, conduct your own research, and seek professional advice from your primary care physician, counsellor, or other relevant healthcare providers if necessary or desired.

Disclaimer:

During the provision of our Products and Services, we may offer personalised advice based on your health goals, diagnostic and functional assessment results, and health history, within the scope of our practice. We recommend that you share any Treatment Plan we provide, including prescribed supplements and lifestyle recommendations, with your primary care physician or other relevant healthcare providers, and discuss these recommendations with them before proceeding. You are solely responsible for any actions you take or do not take based on our recommendations, and you agree to hold us, along with our officers, employees, contractors, and representatives, harmless against any resulting losses, costs, and expenses, in accordance with the provisions outlined below.

General: Subject to the Competition and Consumer Act 2010 (Cth) (Australian Consumer Law) and to the fullest extent permitted by law, we disclaim all express or implied representations, conditions, warranties, guarantees, terms, and similar related to these Terms and any Products or Services we provide.

Australian Consumer Law: Certain provisions of the Australian Consumer Law and other relevant statutes, rules, and regulations may imply non-excludable terms, warranties, or conditions for consumers, including consumer guarantees (Non-Excludable Conditions). Where such conditions cannot be excluded, they are incorporated into these Terms. Our liability for a breach of any Non-Excludable Condition (other than one that cannot be limited by law) is limited, at our discretion, to either resupplying, replacing, or repairing the goods or services involved, or paying the cost of resupplying, replacing, or repairing them.

Limitation of Liability:

Except for liability related to the breach of a Non-excludable Condition, and to the extent permitted by law, we disclaim all liability for any loss or damage of any kind, including indirect, incidental, special, consequential, or exemplary damages. This includes, but is not limited to, damages for loss of business profits, use, goodwill, data, or other intangible losses, the cost of obtaining substitute goods or services, or any other special, indirect, or consequential damages (even if we have been advised of the possibility of such damages), arising out of or in connection with the use of our Products and Services, however caused, including by negligence.

No Guarantee of Outcomes:

We make no guarantees or representations regarding specific results or outcomes (such as curing a particular disease or resolving any symptom or condition) from the use of our Products, Services, or following our advice and recommendations.

 

INDEMNITY

You agree to be liable for and indemnify, defend, and hold us harmless against any claims, liabilities, suits, actions, and expenses, including litigation costs and reasonable legal fees, arising directly or indirectly from: (i) any inaccurate, outdated, incomplete, or misleading information you provide; (ii) any breach of these Terms or related Documents; (iii) any misuse of the Products or Services; and (iv) any violation of laws by you.

 

DISPUTES

You agree to cooperate with us, at your own expense, in handling any disputes, complaints, investigations, or litigation arising from your use of our Products and Services, including but not limited to those related to incorrect information you have provided. This obligation will remain in effect even after these Terms are terminated.

 

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise stated, we own or hold licences for all rights, titles, and interests, including intellectual property rights, related to our Site, the content we post, and our Services and Treatment Plans. Your use of our Products and Services, as well as the submission of your personal and health information, does not grant or transfer any rights, titles, or interests to you regarding our Site or the Products and Services.

 

CONFIDENTIAL INFORMATION

Our Products and Services are for personal use only. You agree not to reproduce, sell, or commercially exploit any part of our Products or Services (e.g. educational materials written by us) without our express written consent. Sharing information from your treatment plan with other healthcare providers is permitted and encouraged.

 

GENERAL

Modifications:

We reserve the right to modify our Products, Services, and these Terms without prior notice. Continued use of our Products and Services following any changes signifies your acceptance of the updated Terms.

Delays:

You acknowledge and agree that we are not liable for any delays or failure to provide our Products, Services, or fulfill other obligations when such delays are caused by events beyond our reasonable control. We will make an effort to notify you of any delays and their anticipated duration.

Severance:

If any provision of these Terms is deemed invalid, unenforceable, or otherwise illegal by a competent authority, in whole or in part, the validity and enforceability of the remaining provisions shall not be impacted.

No waiver:

Failure to enforce any part of these Terms does not constitute a waiver of our right to enforce them later.

Notices to you:

We may send notices to you via email, on our website [https://www.radiantnaturopathics.com.au] , or through other reliable method to an address or using contact information previously provided by you.

Termination:

We may terminate these Terms at any time without notice. Any limitations of liability or obligations under these Terms will survive termination.

Restricting access:

We reserve the right to terminate or restrict your access to our Products and Services at any time without notice.

Privacy:

We are committed to protecting your privacy in line with Australian Privacy Principles as set out in the Privacy Act 1988. Our Privacy Policy can be found on our website.

Email: You acknowledge that we are able to send electronic mail to you and receive electronic mail from you. You release us from any claim you may have as a result of any unauthorised copying, recording, reading or interference with that document or information after transmission, for any delay or non-delivery of any document or information and for any damage caused to your system or any files by a transfer.

Jurisdiction:

Your use of our Products, Services, and these Terms is governed by the laws of Victoria. Any disputes arising from your use of our Services will be subject to the exclusive jurisdiction of the courts in that region.

While our Products and Services are accessible to clients across Australia and internationally, we make no guarantee that they comply with the laws (including intellectual property laws) of any country outside Australia. If you choose to purchase or use our information, Products, or Services from outside Australia, you do so at your own risk and are responsible for adhering to the laws of your local jurisdiction.
